What are we doing ?

Everyday there are countless agreements entered into online for the sale of goods and/or services. When problems arise out of these e-commerce transactions, parties can be located all over the world making it difficult to resolves disputes in one physical location. The parties need a way to resolve these disputes in a way that is as easy and quick as the original online transaction. ILAC Arbitration has the solution.

Why are we doing it ? 

ILAC Arbitration was created to provide a Complete Online Dispute Resolution platform. It offers a way for parties to an agreement (whether between two businesses or an individual and a business) to settle disagreements using either mediation (a non-binding conciliation process) or arbitration (where an Arbitrator makes a final and binding decision under the provisions of Convention on the Recognition and Enforcement of Foreign Arbitral Awards or the New York Convention). Parties can choose between totally online arbitration or Partly online arbitration.

What is online arbitration and what is hybrid arbitration ?

Online arbitration is a process by which parties may consensually submit a dispute to ILAC Arbitration  as a non-governmental decision maker, selected by or for the parties, to render a binding, non-binding or unilaterally binding award, issuing a decision resolving a dispute in accordance with neutral procedure that includes due process in accordance with the parties’ agreement or arbitration tribunal decision. The online arbitration process may be conducted entirely online or partly online by the use of information technology.

In totally online arbitration the entire process is conducted online by the use of email, video conferencing and Web-based communications.

The hybrid arbitration is partly online arbitration and is conducted using a combination of the above-mentioned communication means and offline features such as live in-person hearings and use of fax and post for the submission of evidence, communication between the arbitrators and deliberation of the award.

Usage of arbitration

In order to effectively utilize the different types of online arbitration in transactional disputes, it is important to consider whether the dispute has arisen in an online or offline environment, as well as to take into account the other characteristics of the dispute. While conducting online arbitration in online environments ILAC Arbitration considers disputes that may arise from Business to Business (B2B), Business to Consumer (B2C) and Consumer to Consumer (C2C) transactions. Consideration is also given to the relevant forms of online arbitration available.

How to use ILAC as an alternative resolution authority  ?

In order to be able to select ILAC Arbitration as an alternative dispute resolution authority parties should have included in their contract an arbitration clause indicating ILAC Arbitration as such.

Simple Arbitration Clause:

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the ILAC Arbitration under its Commercial Arbitration Rules of ILAC Arbitration .The number of arbitrators shall be [one or three]. The arbitration shall be entirely online /partially online and the place of arbitration shall be Sofia, Bulgaria. Bulgarian law shall apply. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Arbitration of existing disputes may be accomplished by use of the following:

We, the undersigned parties, hereby agree to submit to arbitration administered by the ILAC Arbitration under its Commercial Arbitration Rules of ILAC Arbitration the following controversy: [describe briefly]. We further agree that the above controversy be submitted to [one or three] arbitrator(s). The arbitration shall be entirely online /partially online  and the place of the arbitration shall be Sofia, Bulgaria, and Bulgarian law shall apply. We further agree that we will faithfully observe this agreement and the rules, that we will abide by and perform any award rendered by the arbitrator(s), and that a judgment of any court having jurisdiction may be entered on the award.

Once you have appointed ILAC Arbitration as an alternative dispute resolution authority you can choose arbiters among our list of experts, which shall be provided accordingly, considering the specifics of your case and business profile.

Each case shall be judged under the Commercial Arbitration Rules of ILAC Arbitration.
